1. INTRODUCTION
1.1. Welcome to Wahda, a global social and communication platform.
1.2. These Terms and Conditions (the “T&C”) tell you the T&C on which you may use the Wahda website at www.wahda.com (the “Site”), the Wahda app (the “App”), and the products, services, and content available from them. In these T&C, we refer collectively to the Site, the App, and the content, products, and services available from them as "Wahda" or the "Service".
1.3. Please take a moment to review the following important sections of these Terms, as they explain key rights and responsibilities relating to your use of Wahda:
a) Our Community Guidelines (Paragraph 10)
b) Our Right to Make Changes to Wahda and to Stop Providing It (Paragraphs 14 And 15)
c) Our Rights to Restrict or Stop Your Access to Wahda (Paragraphs 16 And 17)
d) Our Responsibility to You (Paragraph 22).
1.4. These T&C should be read alongside our Privacy Policy, Community Guidelines, and Supplemental Commercial T&C.
1.5 There will also be other T&C or rules that apply to your use of a particular product or service on Wahda, which we will let you know about before you use the relevant product or service. These additional T&C will form part of these T&C, unless they are third-party T&C that create a direct contract between you and a third party.
2. ABOUT US
2.1. Wahda ("us", "we", or "our") is registered in the Cayman Islands.
3. HOW TO CONTACT US
3.1. Our email address is help@wahda.com.
3.2. Please contact us using the above contact details if you have a question or complaint about Wahda, including any of its content. We will try to answer your enquiry or resolve any complaint as soon as possible.
3.3. Country-Specific Provisions for Users
3.3.1. European Union (EU) and European Economic Area (EEA)
If you live in the EU or EEA, the Digital Services Act (DSA) gives you additional rights, including the ability to challenge our content moderation decisions, use an independent dispute resolution body, and complain to your national Digital Services Coordinator. You can also seek remedies through the courts in your country.
3.3.2. United Kingdom
We comply with the Online Safety Act 2023, enforced by Ofcom. This means we have legal duties to protect you from illegal content and additional duties to protect children online, including age checks for harmful content. Nothing in these T&C limits your rights under the Consumer Rights Act 2015, the Online Safety Act 2023, or the Data (Use and Access) Act 2025.
3.3.3. Australia
Nothing in these T&C removes any rights you have under the Australian Consumer Law or the Privacy Act 1988, including your rights under the Australian Privacy Principles (APP). These rights apply to you regardless of anything else in these T&C.
3.3.4. Malaysia
We process your personal data in line with Malaysia's Personal Data Protection Act 2010, updated by the 2024 Amendment Act (fully in force from June 2025). The updates bring Malaysia's data protection standards closer to international norms, including requirements around sensitive data (such as biometrics) and data breach notification. We also comply with the Communications and Multimedia Act 1998.
3.3.5. Indonesia
We comply with Indonesia's Electronic Information and Transactions Law (UU ITE, as amended in 2024) and the Personal Data Protection Law (UU PDP). We will also act on lawful content removal requests from the Ministry of Communication and Digital (KOMDIGI). Under Indonesia's Government Regulation No. 17 of 2025 on Child Online Protection, we have obligations to protect users under 18, including implementing age-appropriate access controls and requiring parental consent. We are registered as a Private Electronic System Provider (PSE) as required under Indonesian law.
3.3.6. Pakistan
We comply with the Prevention of Electronic Crimes Act 2016, as amended by the PECA Amendment Act 2025. The 2025 amendments established the Social Media Protection and Regulatory Authority (SMPRA), which oversees content compliance and platform registration. We will respond to lawful content removal requests from SMPRA within the required timeframes. You can report unlawful content or conduct through our in-app reporting tool or by contacting us at help@wahda.com.
3.3.7. India
We comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021. You can submit complaints about content or user conduct to our officer via help@wahda.com. We will acknowledge complaints within 24 hours and resolve them within 15 days, as required by law.
3.3.8. United Arab Emirates
Your use of the Service is subject to Federal Decree-Law No. 55 of 2023 and its 2025 implementing regulations, overseen by the UAE Media Council. Content on the Service must comply with UAE content standards, including laws on defamation, public morality, and respect for state institutions. If you create or share promotional or advertising content in the UAE, you are responsible for ensuring you hold any required permits from the UAE Media Council. You are solely responsible for ensuring your content complies with all applicable UAE laws.
3.3.9. Canada
Your use of the Service is subject to Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. We collect, use, and disclose your personal data only for the purposes described in our Privacy Policy, with your knowledge and consent where required by law.
3.3.10. South Africa
Nothing in these T&C limits your rights under the Protection of Personal Information Act (POPIA) or your constitutional right to privacy. We process your personal data lawfully and in accordance with POPIA's conditions for responsible processing.
Note on regulatory changes: Digital laws are evolving rapidly across all our markets. We review and update these provisions regularly. If you have questions about your rights in your country, please contact us at help@wahda.com.
4. HOW WE WILL CONTACT YOU
4.1. We will mainly contact you by the email address connected to your account or by sending push notifications to your device via the App. Where we make material changes to these T&C or our policies, we will notify you via in-app push notification.
4.2. We will use the email provided when creating your account. You must notify us as soon as possible if any of your contact details change.
5. THESE T&C OF USE
5.1. Please read these T&C carefully before you start to use Wahda. When you create an account, you will be asked to confirm your acceptance of these T&C by ticking a box and clicking an explicit "I Agree" button. If you do not agree to these T&C, you must not use Wahda.
5.2. These T&C will always be available on our website. You should regularly check this page to see if any changes have been made and review the T&C whenever we update them, or you use Wahda.
6. CHANGES TO THESE T&C OF USE
6.1. We may make changes to these T&C from time to time. Where changes are significant, we will notify you via in-app push notification and, where appropriate, by email.
6.2. If you do not agree with any changes that we make to these T&C, you can let us know, and we will close your account in accordance with Paragraph 18 below.
6.3. If you continue to use Wahda following any change to these T&C, you will be accepting and agreeing to those changes.
7. CONDITIONS OF ACCESS TO WAHDA
7.1. To use Wahda:
7.1.1. You must be aged 16 years old or over. Where applicable law sets a higher minimum age for use of social platforms or for entering into these T&C, the higher age will apply. Where applicable law requires parental or guardian consent for a user of your age, your parent or legal guardian must review and agree to these T&C on your behalf before you use Wahda;
7.1.2. you must not be barred from using Wahda either by us previously or under the laws of the country where you live, or any other laws that apply to your use of Wahda;
7.1.3. you must not have ever been convicted of a hate crime, terrorism, violent or sexually related criminal offence; and
7.1.4. you must register as a member of Wahda by creating an account (an “Account”).
7.2. You may access Wahda for individual, personal use. Commercial use is permitted only in accordance with our Supplemental Commercial T&C.
7.3. Your access to Wahda and any information, messages, articles, blogs, music, videos, images, photographs, and other content displayed on Wahda (“Content”) is permitted in accordance with, and subject to your compliance with these T&C, including our Community Rules at paragraph 10 below.
8. CREATING AN ACCOUNT
8.1. You can create an Account using your email address or mobile phone number. During registration, you will provide your date of birth and gender and confirm your acceptance of these T&C and our Privacy Policy.
8.2. You must provide us with accurate, complete, and up-to-date information when opening your Account, and you agree to update such information to keep it current. If you do not, we may suspend or terminate your Account.
8.3. You are responsible for all activity on Wahda through your Account. You agree not to disclose your Account login credentials to anyone and to notify us immediately of any unauthorised use of your Account.
8.4. Account security is supported by email and password authentication, phone one-time password (OTP), and device biometric authentication (such as Face ID or fingerprint recognition) where available on your device.
9. USER CONTENT
9.1. Wahda members can use the Service to create, store, or share content such as text, files, documents, messages, articles, blogs, social media links, graphics, images, music, audio, video, stories, and other media ("User Content"). This includes participation in features such as public posts and feeds, direct messaging, short form video, stories, groups and communities, polls and Q&A, AI-assisted content tools, event creation and participation, and map navigation features.
9.2. Any User Content that you post or make available through Wahda is referred to as “Your Content”. Your Content must comply with these T&C, including the Community Rules as set out below. You are solely responsible for all your User Content.
9.3.Licence Grant. You grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of Your Content. This licence is free of charge, lasts for the duration of your use of the Service, and we have the right to grant these rights to third parties, such as our service providers and other members, to the extent necessary to operate the Service.
9.4. You must have, and represent that you have, all rights necessary to grant us the licence in your User Content as described above.
9.5. We do not claim ownership of any User Content. You can remove Your Content by specifically deleting it.
10. COMMUNITY RULES
10.1. You must have, and represent that you have, all rights necessary to grant us the licence in your User Content as described above.
10.2. Authenticity and Integrity. You agree that you will:
10.2.1. Always provide accurate, current, and complete information about yourself and your Account.
10.2.2. Not misrepresent your identity, age, qualifications, or affiliations with any person or entity.
10.2.3. Not create an Account for anyone other than yourself.
10.2.4. Not use or attempt to use another member’s Account.
10.2.5. Not engage in any form of inauthentic behaviour, including creating fake accounts, using automated systems to generate content, or manipulating engagement metrics.
10.3. Safety and Harm Prevention. You agree that you will not post, share, or promote content that:
10.3.1. Violence and Incitement: Threatens, encourages, or incites violence against any person or group, or promotes dangerous organisations or individuals, including terrorist or criminal groups.
10.3.2. Hateful Conduct: Attacks, harasses, or degrades people based on protected characteristics such as race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, gender identity, disability, or disease.
10.3.3. Bullying and Harassment: Targets individuals with malicious content, including threats, public shaming, unwanted sexualisation, doxxing, or repeated unwanted contact.
10.3.4. Exploitation and Abuse: Depicts, encourages, or facilitates the exploitation or abuse of children, including child sexual abuse material (CSAM), or involves human exploitation, such as human trafficking or non-consensual intimate imagery.
10.3.5. Self-Harm: Encourages or provides instructions on how to self-harm, commit suicide, or engage in disordered eating behaviours.
10.3.6. Graphic Content: Contains excessively violent, gory, or graphic imagery or descriptions, unless shared for clearly newsworthy or educational purposes with appropriate warnings.
10.3.7. Disinformation and Synthetic Media: Spreads false or misleading information, or constitutes manipulated or AI-generated synthetic media (deepfakes) presented deceptively.
10.4. Prohibited Content and Activity. You agree that you will not:
10.4.1. Illegal Activity: Promote, facilitate, or coordinate any unlawful content, products, or services, including the sale of restricted goods such as drugs, firearms, or illegal financial instruments.
10.4.2. Fraud and Scams: Engage in fraudulent, deceptive, or misleading practices, including phishing, financial scams, or the distribution of malware or viruses.
10.4.3. Privacy Violations: Share or disclose information that you do not have the right to share, including the private personal information of others (such as contact details, financial information, or medical records) without their explicit consent.
10.4.4. Spam and Commercial Misuse: Send spam or other unwelcome communications, or use the Service for unsolicited commercial advertising or promotion without our prior written consent.
10.4.5. Intellectual Property Infringement: Post content that infringes the intellectual property rights (including copyright, trademark, or patent) of Wahda or any third party.
10.4.6. System Interference: Interfere with or disrupt Wahda or any servers or networks connected to Wahda, including by transmitting worms, viruses, malware, or any other destructive or disruptive code.
10.5. Moderation and Enforcement. We reserve the right, without obligation, to monitor, moderate, edit, disable access to, or remove User Content that we determine to be in breach of these T&C or our Community Guidelines. We use a combination of automated AI/ML classification tools, third-party content safety technology, and human review queues to detect and action prohibited content. We actively enforce against CSAM, terrorism and violent extremism, hate speech, graphic violence, harassment and doxxing, self-harm promotion, disinformation and synthetic media, non-consensual intimate imagery, and drug and weapon sales, among other categories. We may also cooperate with law enforcement authorities where required.
10.6. Appeals. If you believe that a content moderation decision has been made in error, you may appeal that decision using the in-app appeal function or by contacting us through our Support page at help@wahda.com. We will review your appeal and respond in a reasonable timeframe.
10.7. Religious Content Disclaimer. Religious content made available on Wahda, including but not limited to prayers, Quran content, educational materials, and user-generated content, is provided for general informational and educational purposes only. We do not represent or provide official religious rulings (fatwas) and do not act as a religious authority. Religious interpretations and practices may vary based on scholarly opinions, schools of thought, and individual beliefs. Users are encouraged to consult qualified religious scholars or trusted religious authorities for specific religious guidance. Any views expressed by users do not necessarily reflect the views of Wahda.
11. NOTIFICATION OF UNLAWFUL CONTENT
11.1. If you believe that any User Content published on Wahda infringes any third-party rights (including your own), is untrue, offensive, unlawful, or otherwise fails to comply with these T&C, you may notify us by emailing help@wahda.com or by clicking the "Report" button in the App.
11.2. Upon receiving a complaint about User Content, we will review the content in question and take appropriate action. Where a complaint results in action being taken, the affected user will have the right to appeal in accordance with Paragraph 10.6 above.
12. OUR RIGHTS IN WAHDA
12.1. We are the owner or the licensee of all intellectual property rights in Wahda, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
12.2. Wahda and the Wahda logo are trademarks of Wahda. You are not permitted to use them without our approval.
12.3. You may only view, download, store, print, use, quote from, and cite Wahda and the User Content for your own personal, non-commercial use, and only on the condition that you give appropriate acknowledgment where required.
12.4. If you print off, copy, download, share or repost any part of Wahda in breach of these T&C, your right to use Wahda will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
13. RIGHTS AND T&C FOR APPS
13.1. App License. If you comply with these T&C, we grant to you a limited non-exclusive, non-transferable license, with no right to sublicense, to download and install the App on your personal devices and to run the App solely for your own personal non-commercial purposes.
13.2. Except as expressly permitted in these T&C, you may not: (i) copy, modify, or create derivative works based on the App; (ii) distribute, transfer, sublicense, lease, lend, or rent the App to any third party; (iii) reverse engineer, decompile, or disassemble the App; or (iv) make the functionality of the App available to multiple users through any means.
14. CHANGES TO WAHDA
14.1. Wahda is evolving over time. We may change its content and features at any time.
14.2. We will provide updates, including security updates, to Wahda to ensure that it continues to comply with the T&C of our contract with you. We may ask you to install these updates.
14.3. We can make changes to Wahda to: (i) ensure compliance with all relevant laws, including consumer laws; (ii) address changes in law or regulation; or (iii) make minor technical adjustments and improvements, for example, to address security concerns.
14.4. We will provide you with reasonable notice of any significant changes to the features of the Service.
15. WITHDRAWAL OF WAHDA
15.1. We can stop providing Wahda or any part of the Service at any time. Where we do not believe you to be at fault, we will provide reasonable notice before doing so.
16. OUR RIGHT TO RESTRICT, SUSPEND OR END YOUR ACCESS TO WAHDA
16.1. We may restrict, suspend, or close your Account with immediate effect, at any time, if we reasonably believe that you are in breach of these T&C or are otherwise misusing Wahda in any way.
16.2. We may also close your Account by providing you with notice of termination via email for legitimate business reasons.
17. WE CAN SUSPEND ACCESS TO WAHDA
17.1. We can suspend the access of Wahda to: (i) deal with technical problems or make minor technical changes; (ii) make updates to reflect changes in relevant laws and regulatory requirements; or (iii) make changes to Wahda as described in Paragraph 14.
18. HOW YOU CAN CLOSE YOUR ACCOUNT
18.1. You may close your Account at any time by: (i) emailing help@wahda.com; or (ii) clicking "Delete Account" in the Settings section of the App and following the steps provided.
19. CONSEQUENCES OF ACCOUNT CLOSURE
19.1. When your Account is closed, your access to Wahda will cease and you will lose access to all content associated with your Account.
19.2. Where your Account is deleted, your account will become inaccessible immediately. All personal data associated with your Account will be permanently deleted within 30 days of the deletion request, unless we are required by law or regulation to retain it for a longer period.
19.3. Where your Account is deactivated rather than deleted (for example, where account functions are restricted pending review of a reported violation), all data will be retained. You may appeal a deactivation decision in accordance with Paragraph 10.6.
19.4. On request, we will provide you with a copy of Your Content in a machine-readable format within 30 days of your account closure, subject to any applicable legal restrictions.
20. YOU HAVE RIGHTS IF THERE IS SOMETHING WRONG WITH THE SERVICE
20.1. We will operate Wahda and provide the Service using reasonable skill and care.
20.2. If you think there is something wrong with Wahda or the Service, please contact our Customer Service Team at help@wahda.com.
21. YOUR RESPONSIBILITY
21.1. You are solely responsible for your interactions with other members. Always use your best judgment and take appropriate safety precautions when communicating with other members through Wahda.
21.2. You must report all suspicious and offensive behaviour that you experience or witness from another member and any other concerns about another member or about any Content by emailing report@wahda.com or through the ‘Report’ button in the App.
22. OUR RESPONSIBILITY TO YOU
22.1. We do not guarantee that Wahda will be compatible with all hardware and software which you may use. We do not guarantee that the Service will be available at all times or at any specific time.
22.2. We will never be responsible for any loss or damage that is: (i) not reasonably foreseeable; (ii) caused by a failure by you to comply with these T&C; (iii) a business loss; (iv) caused by a failure by you to install any update provided with sufficient installation instructions within a reasonable time; or (v) something you could have avoided by taking reasonable action.
22.3. We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
22.4. We are not responsible for the conduct of any member. We do not verify the accuracy of statements made by users.
23. LINKING TO WAHDA
23.1. You may link to Wahda, provided you do so in a way that is fair and legal, and which does not damage our reputation or take advantage of it.
23.2. We reserve the right to withdraw linking permission without notice.
24. EXTERNAL LINKS ON OUR PLATFORM
24.1. Wahda may contain links to third-party websites and services. If you decide to visit any third party site or use a third-party service, you do so at your own risk. We are not responsible for the content, products, or services on or available from those resources.
24.2. Your browsing and interaction on any other website, or your use of other services, is subject to that service provider’s or operator’s own T&C, rules, and policies.
25. LEGAL
25.1. Each of the clauses of these T&C operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.
25.2. These T&C are personal to you. You may only transfer your rights or obligations under these T&C to another person if we agree to this in writing.
25.3. We may transfer our rights and obligations under these T&C to another organisation. We will always tell you in writing if this happens and will ensure that the transfer will not affect your rights under these T&C.
25.4. These T&C shall be governed and construed in accordance with each jurisdictional law.
